Welcome to SHOTPLANS. These Terms of Use ("Terms") govern your access to and use of the SHOTPLANS application, website, and related services (collectively, the "Service") operated by shotplan / FilmLV ("we," "us," or "our"). By installing, accessing, or using SHOTPLANS, you agree to be bound by these Terms.
1. The Service
SHOTPLANS is a planning and pre-visualization tool for film, television, photography, and theatrical productions. It enables users to design overhead shot plans by placing cameras, lights, actors, props, lamps, chairs, set walls, and other production elements on a digital canvas, and to organize plans into shot lists.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use SHOTPLANS. By using the Service, you represent that you meet this requirement and that you have the legal authority to enter into these Terms.
3. Your Account & Your Content
SHOTPLANS does not require an account. Shot plans you create are stored locally on your device unless you choose to export, share, or import them.
- Ownership: You retain all rights to the shot plans, project files, and creative content you create using SHOTPLANS. We claim no ownership of your work.
- Responsibility: You are solely responsible for the content of your plans and for any consequences of sharing exported files with third parties.
- Backups: Because data is stored locally, it is your responsibility to back up your projects by exporting them. We are not liable for any loss of data resulting from device failure, browser cache clearing, app uninstallation, or other causes.
4. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by applicable law;
- Use automated means (bots, scrapers) to access the Service in a manner that overloads or disrupts it;
- Interfere with the security or integrity of the Service or any related infrastructure;
- Misrepresent yourself or impersonate any person or entity in shared exports;
- Use the Service to plan or facilitate illegal activity.
5. Intellectual Property
The SHOTPLANS application, including its name, logo, code, design, icons, user interface, and underlying technology, is owned by shotplan / FilmLV and protected by copyright, trademark, and other intellectual property laws.
We grant you a personal, non-exclusive, non-transferable, revocable license to use SHOTPLANS for lawful purposes consistent with these Terms. This license does not grant you any rights to redistribute, sublicense, or commercially resell the Service itself.
6. Updates & Changes
We may update SHOTPLANS from time to time to add features, fix bugs, improve performance, or address security issues. We may modify or discontinue the Service (in whole or in part) at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Service.
7. Third-Party Services
If SHOTPLANS is distributed through third-party platforms (such as the Google Play Store or Apple App Store), your use of the Service is also subject to those platforms' own terms. We are not responsible for the policies or practices of third-party platforms.
8. Disclaimer of Warranties
SHOTPLANS is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, in no event shall shotplan, FilmLV, its affiliates, owners, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
Our total cumulative liability to you for any claim arising from the Service shall not exceed the amount you paid to us for the Service in the twelve months preceding the claim, or USD $25, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless shotplan, FilmLV, and their affiliates from any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by uninstalling the application or ceasing to access the website.
12. Governing Law
These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. The "Effective date" at the top of this page will reflect the latest revision. Material changes will be noted in the app or on the website. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
